Welcome to TheCodeDealer ("we", "us", "our"). TheCodeDealer is an online learning platform operated from the United Kingdom. By accessing or using our website at thecodedealer.io (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our Platform.

1. About the Platform

TheCodeDealer is an online learning management system (LMS) that provides video courses, standalone lessons, downloadable resources, and educational content focused on software development. Topics include but are not limited to JavaScript, TypeScript, React, Node.js, Python, databases, authentication, deployment, and DevOps.

2. Eligibility

You must be at least 16 years of age to create an account and use our Platform. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features of the Platform, you must register for an account. You may register using an email address and password, or through a third-party authentication provider (Google or GitHub). You agree to:

  • Provide accurate and complete information during registration;
  • Keep your login credentials secure and confidential;
  • Notify us immediately of any unauthorised access to your account;
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Subscriptions and Pricing

TheCodeDealer offers both free and paid content. Paid access is available through the following options:

  • One-Time Course Purchases: Individual courses may be purchased for a one-off fee. Upon successful payment, you receive permanent access to that specific course.
  • Pro Subscription (Monthly): A recurring monthly subscription granting access to all courses on the Platform.
  • Pro Subscription (Yearly): A recurring annual subscription granting access to all courses on the Platform.
  • Lifetime Access: A one-time payment granting permanent access to all current and future courses on the Platform.

All prices are displayed on the Platform at the time of purchase and are denominated in US Dollars (USD). We reserve the right to change our pricing at any time. Any price changes will not affect existing active subscriptions until the next renewal period.

5. Payments

All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service. We do not store your payment card details on our servers. For recurring subscriptions, your payment method will be charged automatically at the start of each billing cycle unless you cancel before the renewal date.

6. Cancellation Policy

You may cancel your recurring subscription at any time through the subscription management section on your Profile page. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period;
  • You will continue to have full access to all Pro content until your subscription expires;
  • Once your subscription period ends, your access will revert to free-tier content and any individually purchased courses.

7. Refund Policy

All one-time purchases on TheCodeDealer, including individual course purchases and Lifetime Access, are non-refundable. By completing a purchase, you acknowledge and agree that you will not be entitled to a refund. We encourage you to review free preview content and course descriptions before making a purchase decision.

For recurring subscriptions (Monthly and Yearly plans), we do not offer refunds for the current billing period. However, you may cancel your subscription at any time through your Profile page. Upon cancellation, you will retain full access to all Pro content until the end of your current billing period (see Section 6 — Cancellation Policy).

If you believe a charge was made in error or you experience a technical issue that prevents you from accessing purchased content, please contact us at thecodedealer24@gmail.com and we will investigate on a case-by-case basis.

By accessing digital content on the Platform (such as streaming a video or downloading a resource), you acknowledge that the statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 no longer applies to that content. This refund policy does not otherwise affect your statutory rights under UK consumer law, including the Consumer Rights Act 2015.

8. Content Licence

Upon purchasing or subscribing, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the course content for your personal, non-commercial educational use. This licence does not permit you to:

  • Copy, reproduce, distribute, or publicly display any video content;
  • Download, record, or capture video streams by any means not expressly provided by the Platform;
  • Share your account credentials or allow others to access content through your account;
  • Use any content for commercial purposes, including resale, repackaging, or incorporation into other products or services;
  • Reverse engineer, decompile, or attempt to extract source code from the Platform.

Downloadable resources (such as source code, PDFs, and documents) are provided for your personal educational use. Any source code provided as part of course materials may be used in your own personal or commercial projects, but may not be redistributed, resold, or used to create competing educational content.

9. Intellectual Property

All content on the Platform, including but not limited to videos, text, graphics, logos, images, course materials, source code examples, and downloadable resources, is the property of TheCodeDealer or its content creators and is protected by United Kingdom and international intellectual property laws. The TheCodeDealer name, logo, and branding are our trademarks and may not be used without our prior written consent.

10. User Conduct

When using the Platform, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights;
  • Upload or transmit any harmful, offensive, or unlawful content;
  • Attempt to gain unauthorised access to any part of the Platform, other user accounts, or our systems;
  • Use automated tools, bots, or scripts to access, scrape, or interact with the Platform without our express permission;
  • Interfere with or disrupt the Platform's infrastructure or services;
  • Share, redistribute, or pirate course content in any form;
  • Create multiple accounts to circumvent restrictions or abuse free trials or offers.

We reserve the right to suspend or terminate your account, without refund, if you engage in conduct that violates these Terms.

11. Third-Party Services

The Platform relies on third-party services to deliver its functionality. These include, but are not limited to:

  • Stripe for payment processing;
  • Mux for video streaming and delivery;
  • Supabase for authentication services;
  • Cloudinary for image hosting;
  • Loops for newsletter and email communications.

Your use of the Platform may be subject to the terms and policies of these third-party providers. We are not responsible for the practices, content, or availability of third-party services.

12. Newsletter and Communications

If you subscribe to our newsletter, you consent to receiving periodic emails including tutorials, coding tips, course announcements, and promotional offers. You may unsubscribe at any time by clicking the unsubscribe link included in every email. Unsubscribing from the newsletter does not affect your account or access to purchased content.

13. Availability and Modifications

We strive to keep the Platform available at all times, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend the Platform for maintenance, updates, or circumstances beyond our control. We reserve the right to modify, update, or remove course content at any time without prior notice. This includes updating course materials to reflect current technologies, restructuring courses, or retiring outdated content.

14. Disclaimer of Warranties

The Platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the content will meet your specific learning objectives, that it is free from errors or omissions, or that the skills taught will result in employment or income.

15. Limitation of Liability

To the maximum extent permitted by applicable law, TheCodeDealer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Platform. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to TheCodeDealer in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

16. Indemnification

You agree to indemnify and hold harmless TheCodeDealer, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also be entitled to bring proceedings in the courts of your country of residence.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
